Liquidation

Liquidation is the formal process of winding up a company, during which a liquidator takes control of its affairs, realises its assets and distributes the proceeds in accordance with the law. It may be considered where a company cannot pay its debts or can no longer continue as a viable business.

Tax relief may be available where a taxpayer cannot settle an outstanding SARS debt in full, either through a compromise of part of the debt or an approved payment arrangement. Each option is subject to legal requirements and SARS approval and must be supported by an appropriately prepared application.

Business rescue is a formal process intended to rehabilitate a financially distressed company under the supervision of a business rescue practitioner. It provides temporary protection against creditor claims while a plan is developed to restore the business or achieve a better return for creditors than immediate liquidation.

The right business and wealth structure can help organise ownership, separate risk, safeguard assets and support succession and long-term planning. Companies, trusts and other arrangements should be structured around the client’s commercial and family objectives while meeting applicable legal, tax and governance requirements.

A trust is a legal arrangement in which trustees control and administer property for beneficiaries or another lawful purpose. Trusts can support estate planning, succession, asset management and business objectives, but must be properly created and administered

Medical law governs the rights, duties and professional standards that apply to the provision of healthcare. It includes regulatory compliance, professional conduct, informed consent, patient confidentiality, medical negligence and related disputes.

Insolvency litigation covers disputes and court proceedings arising from liquidation or sequestration. These matters may include recovering assets and debts, challenging improper transactions, conducting insolvency enquiries and protecting the interests of parties affected by insolvency.
